These terms apply to your use of hireopscale.com and its chat and voice assistants (the "Site"), operated by OpScale LLC, a Florida limited liability company ("OpScale", "we"). By using the Site you accept them. If you do not, please do not use the Site.
1. What the Site is, and is not
The Site describes OpScale's services and lets you contact us, book a call, talk to an assistant and apply to work with us. Nothing on the Site is an offer that binds either of us. Services are provided only under a signed Master Services Agreement and Statement of Work, and where those documents and these terms differ, the signed documents control.
2. The AI assistants
The chat and voice assistants on the Site answer with an AI model. They can be wrong, incomplete or out of date, and they do not give legal, financial, medical or employment advice. Treat what they say as a starting point for a conversation with a person, not as a commitment by OpScale. Anything you tell them is handled as described in the privacy policy. Do not share another person's confidential information, protected health information or privileged material with the assistants.
3. Using the Site
You agree not to:
- use the Site or the assistants to break a law or another person's rights;
- probe, scan, overload or interfere with the Site or its providers, or bypass its security or anti-bot checks;
- submit false contact details, impersonate anyone, or send unsolicited messages through our forms;
- scrape, copy or republish the Site's content or the assistants' output at scale, or use either to train a model;
- reverse engineer the Site or attempt to extract its source, prompts or configuration.
If you believe you have found a security issue, the contact in /.well-known/security.txt is the right place; we read every report.
4. Accounts, bookings and applications
When you book a call or send a form you confirm that the details are yours or that you are allowed to give them. Applications are governed by the applicant notice at /privacidad-candidatos. We may decline or cancel a booking or application at our discretion.
5. Intellectual property
The Site, its text, design, images, code, the Jack character and the OpScale name and marks belong to OpScale or its licensors. You may view the Site and print pages for your own evaluation of our services. Any other use needs our written permission. What you send us through the Site stays yours; you give us permission to use it to answer you and provide what you asked for.
6. Third party links and tools
The Site links to and embeds tools run by others, such as scheduling and the voice provider. Their terms govern your use of them. We are not responsible for sites we do not operate.
7. What we do not promise
THE SITE AND THE ASSISTANTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITE WILL BE UNINTERRUPTED, ERROR FREE OR SECURE, OR THAT THE ASSISTANTS' ANSWERS WILL BE CORRECT.
8. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, OPSCALE AND ITS MEMBERS, CONTRACTORS AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA, ARISING FROM YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (USD 100). THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED BY LAW, AND IT DOES NOT APPLY TO SERVICES PROVIDED UNDER A SIGNED AGREEMENT, WHICH HAS ITS OWN TERMS.
9. Indemnity
You will defend and hold OpScale harmless from claims arising out of your breach of these terms or your misuse of the Site.
10. Governing law and venue
Florida law governs these terms, without regard to its conflict of laws rules. Any dispute about the Site will be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction. Nothing here limits a consumer protection right you have under the law of the place where you live.
11. Changes and termination
We may change these terms by posting a new version with a new date; your continued use after that is acceptance. We may suspend or end access to the Site for a breach of these terms.
